Ask an Alim

wrong reciting of mutah

Q:

Salamun `alaykum wa Rahmatullahi wa Barakatuhu,

I have few questions and need answer very urgently, I request you to please answer.

1) if a man and a woman, wanted to have mutah, and it was very clear to them they are entering into temporary marriage , but by mistake they have recited the formula of nikah in place of mutah.
Kindly advide that is this nikah/mutah valid or void.
Please note none of them was intended to recite formula of permanent marriage.

2) if it is to be considered as permanent marriage than what is the fastest way to exit this alliance.

3) do they have to recite the formula for mutah again to continue the temporary marriage.

A:

Salaamun alaykum.

Refer the Link: Conditions of Temporary Marriage – Mutah

1- Because they had intended to recite the formula of the temporary marriage and in that one has to specify the time and the amount of Mehr and if it was not specified, then that nikah is void.

2- Because the nikah is void, there is no need for a divorce.

3- They will have to recite the formula of temporary marriage again and specify the time and the Mehr.

Regards
Zahra Davdani.
