Ask an Alim

Where does the son who married my ex sister stand, he is a Hindu?

Q:

My ex sister married a man who divorced a Hindu girl. His mother did the same. She married an already married hindu man and divorced him later ,He went to Delhi and remained with his wife and grown kids. He passed away and was cremated.

Where does the son who married my ex sister stand, he is a Hindu? The mother is claiming to be a Muslim and harassing me. She is divorced alone and lost from both worlds!

Please  guide

Waalaykum al-Salam
Thank you for your Question.

I’m unsure of what you mean by “ex-sister”. If it means you have cut ties with your sister. Then this is Haram. It is an act that Allah (az) dislikes a lot and entails a lot of consequences which are very unpleasant for e.g. decrease in life span, sustenance…etc
Hence, please take this seriously and mend your relation.InshaAllah.

Regarding the question itself ( Hopefully I have understood your question well):

If the man your sister is married to is claiming to be a Muslim then he is. And you do not need to worry about this.

In regards to his mother However:

1- If she had married a Hindu man, then her marriage was void according to Islamic laws. Because, a Muslim woman cannot marry other than a Muslima man. And any child(ren) born out of that would be illegitimate. (And if the man your sister is married to, may have been illegitimate. But again, if he is claiming to be a Muslim then yes, he can certainly marry a Muslim woman).

2- If she had married a man who had claimed to be a Muslim then, then their marriage was in order and the child(ren) out of the marriage would be legitimate. And your sister can certainly marry him if he claims to be a Muslim.

Either way. Your sisters marriage to a Muslim man is in order.
hopefully, I was able to answer your question.
