Portions of Inheritance

Salamun alaikum, I have below questions will appreciate your assistance, 1. There is a A Family of of Five in Total. That is – Father, Mother – 2 Daughters and one son. In case of Death of The Father who has left a General Islamic Will without any Conditions, How will the Late Father’s Estate be Divided amongst the Heirs ? 2. A Family of Three in total. That is – Father – Mother and a Daughter. In case of Death of The Father who has left a General Islamic Will without any Conditions, How will the Late Father’s Estate be Divided amongst the Heirs? 1. Mother will receive 1/8 of the estate. The rest should be divided in 4 parts. 2 parts to son and 1 each to daughters.

2. Mother will receive 1/8 of the estate. The rest should be divided in 2 equal parts for the daughter.

NOTE: A wife (mother in this case) does not inherit anything from the land of a house or a garden or a farm, or from any other land, nor does she inherit from the proceeds of such lands. She does not also inherit from that which stands on that land, like the house and the trees, but she inherits from their proceeds. The same rule applies to the trees and crops and buildings standing on the land of a garden, and on agricultural land, or on any other lands.

al-wājib al-muʿayyan – assigned obligation; time-specific obligation, i.e. an act of worship that must be performed at one distinct time

al-wājib al-takhyīrī – optional obligation, i.e. an act of worship for which a mukallaf has the choice to either perform that act itself or some other particular act

al-wājib al-taʿyīnī – fixed obligation, i.e. an act of worship for which there is no alternative act that a mukallaf can perform instead
