What is our Nikkha status when we have divorced through the court

Q:

I entered into marriage through Nikah in UK. Since Nikah is not recognised as a legal marriage in the Uk we went through the registration process. Now I have got a divorce decree from the court , I was wondering what is the status of our Nikah? Shall I have get that Nikah dissolved? If yes how and where to apply for?

Wa-Alaykum Assalam Wa Rahmtu-Allah,

The legal system in the UK is separate to the Sharia system… so you will need to dissolve the marriage religiously in order to nullify the marriage and divorce your wife (if you are the husband) or ask your husband to properly/religiously divorce you (if you are the wife). Once certain that this has occurred, the wife will then have a period of time after that date called “iddah” in which the husband is still responsible for his wife in terms of shelter, expenditure, living expenses etc and the wife can not remarry until this period is over.

The divorce needs to take place at times not during the cycle of the wife and in a month that they have not been intimate.

You need two witnesses and you should ask a learnerd scholar to recite the correct divorce statement.
