Ask an Alim

Executing nikkha by Sunni Shaikh for the second time for the same couple

Q:

As salam o alekum
Our relative’s daughter (Shia), who was divorced earlier, has engaged with a new person (Sunni). They performed Nikkah as per Shia practice (2 shia Molvi performed the nikkah in presence of numerous relatives of the girl) and started living together. The boys parents were against this marriage and they never accepted this nor they attended. however the boy bought a separate house for this girl and started their marital life. In the meantime, the boy was regularly meeting with his parents. After 3.5 years, his parents got agreed on the condition that if the Nikkah is recited again as per Sunni practice, then they will keep the girl with them as their daughter in law. The girl’s family accepted their condition and preparing for their remarriage.
Question.
What are the consequences, what will be the status of first nikkah as per shia rulers and what is the validity of this new nikkah going to happen soon as per Sunni fiqh.
And what should be the role Girl’s relatives who attended their first Nikkah, because they dont like this and are criticizing.
Please answer in detail and in understanding manner by a layman.
Many Thanks and best regards

Salaamun alaykum
Thank you for your question.

The first nikah is valid and there is no problem in a Sunni Shaikh reciting the nikah again.

Q17) We are a Shia family. A Sunni gentleman has asked for my sister’s hand in marriage. He is a very good and descent man. He is a good Muslim. We would like to know if there is anything in the Shia faith that prevents such a marriage. (That makes it haram)?? Plus is it ok if a Sunni Sheikh performs the wedding contract?? Is it ok if a Shia Sheikh performs the contract?

A17) There is no objection with regards to Sunni Sheikh’s reading of the contract. But it is not permissible for a Shia girl to marry a Sunni man, if she fears being misled by him.
