Ask an Alim

Life insurance/inheritance

Q:

If one has a life insurance policy and then dies, does the money obtained throughout this insurance go into the deceased’s will/inheritance?

A:

Salamun Alaykum

Thank you for your query.

Life insurance is primarily given to the beneficiary or beneficiaries. Life insurance is paid after the death of the person or persons whose names are mentioned in the insurance policy. If the insurance company knows the money to be the money of the deceased person then that would go into inheritance.

One should act according to the insurance policy. If an insurance company gives money to all the children then it should be distributed amongst all of them but if the insurance company gives to only one child whose name is written in the agreement then that money will not be divided into inheritance.

You can check the insurance policy. They may have written the names of the inheritors by which you can see which category does this scenario falls.

According to Ayatullah al-Udhma Sayyid Ali Sistany:

Question: Is it permissible to cheat insurance companies in non-Muslim countries when one is confident that it would not tarnish the image of Islam and Muslims?

Answer: It is not permissible.
