Ask an Alim

Islamically is there something unlawful about Second Mortgage property?

Q:

Salaam alaykum wr wb,

My father and I have already committed to buying a second property under my name and will soon be applying to get a mortgage under my name. He wants this to make my life easier in the future. I currently do not possess the financial means to undertake this task and he is assisting me, though it is possible that I may not live in this house and may rent it instead. So from a Islamic legal perspective, is there anything about this transaction that may be unlawful?

May Allah bless your efforts and the askanalim team!

A:

Wa Alaykumussalam

Thank you for your query.

No, there is no problem in the mentioned scenario.

On the other hand, make sure you pay Khums for whatever is eligible for Khums.
