Ask an Alim

Is the money I have earned through commission halal or haram?

Q:

I am mechanical engineer in Bahrain. i have been involved in many construction projects. Sometimes contractor gets the project at a fixed price and during execution of the project while supervising I agreed with them to pay me certain percentage so that their work is not delayed due to my approval and my approval is done faster . Some other cases I have neglected small deviation from specifications (not major) to felicitate the contractor. Unfortunately I have mixed this money with my salary and I have no records how much amount I have taken through this commission. I want to know if this is halal and if not what can be done to rectify my error. I have pruchased a car and a house using this money

Salamun Alaykum

Thank you for your query.

Are you sure you failed to fulfill your duty? If yes, then to the extent that you are sure you did not do the job correctly, you should return the fee/money you received from the person/employer.

If there is no shortage of work that means you fulfilled your duty properly and is not considered a fault and damage or loss wasn’t involved, then there is no problem.

In other words, if it is not against the rules and regulations and laws, and there is no shortage in fulfilling the duty flawlessly/accurately i.e: you fulfilled your duty correctly, then there is no problem in it.

Please see where you stand according to the explanation given above, and then act accordingly.

May Allah(swt) grant you success
