Ask an Alim

Is Selling Replica/counterfeit products haram??

Q:

I am an online seller with a very good income. I have been selling replica products recently alongside other products and they have a very good profit margin. The country rules do not forbid it and it is everywhere. It is replica sunglasses such as Ray-Ban and Lacoste etc.
There is no mention that it is original but also no mention that it is fake. The price is usually much cheaper that is 1/4 or 1/5 of the original sunglasses. So is my income from these products shady or Haram?

Waiting for your guidance.

A:

Wa Alaikum al-salam

thanks for your question

According to ayatollah sistani one of haram transaction are  transactions in which there is deceit.

“Deceit can take place in different ways, such as:

  1. mixing a good item with a bad one or with something else; for example, mixing milk with water;
  2. making an item appear better than it really is; for example, spraying water onto old vegetables to make them appear fresh;
  3. feigning an item as something else; for example, gold-plating an item without informing the buyer [that it is not solid gold];
  4. concealing a defect in an item when a buyer trusts the seller to not conceal defects.” (https://www.sistani.org/english/book/48/2298/)

If selling products without informing customers about its condition (such as being fake or original) considered an example of deceit then it’s haram. For your assurance it’s better to point it to your costumers.
