Ask an Alim

Is paying more than the original amount comes under haram ?

Q:

As salam aleykum …
Is paying more than the original amount comes under haram ?
Like paying fainance of our vehicle
And hand loan if loaners are demanding more money than given ..?

A:

In the name of God,

Salam Alaykum,

I am assuming that you are residing in a non-Muslim country and that you are referring to paying interest on your car loan that you took from the bank. Based upon these assumptions, the answer that I can provide here is that according to Ayatullah Sistani, this would be o.k. under certain conditions. You shouldn’t make the intention that you will pay extra to what you borrowed, even if practically speaking, you end up doing so. On his website, a question similar to what you asked exists:

“Question: Can I take an urgent loan from a non-Muslim bank, even if I know that the bank will charge interest?

Answer: If a Muslim intends to get a loan from such banks, it is necessary that he should do so with the intention that it is a transaction without return, even if he knows that he will end up paying the capital as well as the interest. And he should not do so with the intention of getting the loan with the condition of [paying] interest.”
I hope that helps, inshallah.
Ma al-salam,
