Ask an Alim

Is it permitted in Islam to become a judge and ruling the judgment by man made law?

Q:

Assalamu Alaikum,
I am an university student and now I am studding law. My ambition is to become a judge in our judiciary system. But our judiciary system doesn’t follow the divine(Allah’s law) law. It is fully depends on man made law which is common law system.
In this above system all kind of judgment given by common law or man made law. So, it this situation is it permitted in Islam to become a judge and ruling the judgment by man made law?
Please, give me the appropriate answer and help me to find out the real path of Allah.
Jazakamullah Khair.

Wa Alaykumussalam

Thank you for your question

“Whoso judges not according to what God has sent down-they are the unbelievers”.  (Surah Maida/44)

“Whoso judges not according to what God has sent down-they are the evildoers”. (Surah Maida/45)

“Whosoever judges not according to what God has sent down-they are the ungodly”. (Surah Maida/45)

If a person knows he is going to make an unjust verdict, he should not work there. In other words it is not permissible if it is against God’s command and you are bound to make the wrong verdict and statements if the judiciary system isn’t according to the proper Quranic law. If you think you can judge according to the correct teachings of Quran then one can, rather should become a Judge.

Some of the Muslim countries have the judiciary system according to Islamic teachings.

May Allah(swt) grant you success
