Inheritance

Q:

As-salamun alaikum,

If the daughters of a deceased man, when their father was alive say that they are not interested in their fathers property and want nothing from it, but come and claim their share after the fathers death, and if the father has not made any written will but has verbally told his sons that the property belongs to them, so Do the daughters have share after their father’s death. Can they change their words?

Please guide.

A:

Alaykum Salaam.

Once the father has announced his will and she has accepted it, she can’t demand it after his demise. However, initial declaration has no legal entity.

Moreover, If there is no consent from the daughter, father’s will will be limited to one third of the assets.
