Ask an Alim

Inheritance issue .

Q:

My Father in law left a will according to Islamic law divided between his children.

Family are disputing this stating his sisters have rights.

The sisters denounced their right 30 years ago. They wrote this through a POA.

What shall we do?

A:

Alaykum Salaam

In the presence of children, who are counted as first degree heirs, the
sisters of the deceased do not inherit, unless he has specified a share
for them in the one-third of his estate over which he has a say.
