Inheritance-Do i have to tell my brother about the locker?

Q:

Asalam o alaikum, me and my mom have a joint locker in a bank, she wants me to take all belongings of that locker after her death (god forbid), she has made her sister witness about it also, i have one brother who doesnt know about that locker and he is not good to my mother too, my question is in case of my mother’s death is it ibligatory on me to tell my brother about locker or do he will have any share in it as per Islamic law ?

A:
Wa Alaykumussalam

Thank you for your question

If the mother gifts the amount to the son in her life then there will be no issue after her demise as the gifted amount will not be considered as inheritance. It would be better that the mother gives or gifts the amount to the son in her lifetime otherwise after the demise the rulings must be followed.

Also, there must be witness according to the Islamic Sharia’h i.e to have 2 male, adult, sane witnesses.

If your mother gifts the amount in her lifetime with the witnesses then there will be no need to tell your brother. But if the amount is not gifted in the lifetime then it must be counted in inheritance.

Inheritance rulings according to Ayatullah al-Udhma Sayyid Ali Sistany:
