Ask an Alim

In a distressed emotional state and I messaged my wife the word ‘talaaq’ 3 times

Q:

Salaam

I am emailing you today in hope that you can hear my situation i am currently in and guide me forwards in regards to this matter.

Myself and my wife have been married for 4 years. We have had our ups and downs in our marriage like most marriages do. I remember there was a time me and my wife had a big argument 3 years ago and out off extreme anger i sent her a text message saying the word ‘talaaq’. We made up few days later and carried on living are lives then a few weeks later over the phone I said the word talaaq again to her and that was it I knew I had only said it twice

Recently about 6 weeks ago me and my wife had another big argument, this time i was in a very very emotional and in a distressed emotional state and messaged her the word ‘talaaq’ 3 times. I immediately regretted sending her the text and came to see her. She was on her menses the day I messaged her. We spoke and i calmed down and we made up. Week went by we had sexual intercourse and thereafter many times.

We both do love one another and really want things to work out but after my big mistake of sending her that message i cant stop but think am I actually divorced to her? I have been researching on the internet constantly but some say the divorce is not valid others say it is.

We would like to have children soon but this is something that is bugging me constantly. I am willing to come in and speak about this matter with a imaan. I really do wish that this was not counted as a divorce so we can live together in peace.

I look forward to hearing back from you.

Thankyou.

Kindest regards,
Asad Ajaz

A:

Waalaykum Salam,

Thank you for your Question

The following is according to the Shia sect.
For a divorce to be correct, it has to have the following conditions:

1- You have to have two believing adults as your witness
2- The woman has to be clean of her menstrual period and also shouldn’t be pregnant
3- Proper Arabic words need to be uttered for the act to take place.

Best wishes
