Ask an Alim

If children do not fulfill the will of father after his death.

Q:

ASLAM O ALIKUM

sir my father donate 1/3 of a plot to masjid oral in front of all family members.
now after my father death if the son/daughter not fulfill the will of father
then what are the consequence please englighten in this matter in light of quran and hadees.

Wa alaykum salaam

Thank you for your question.

It is compulsory upon the heirs to act upon the will.
According to Ayatullah Sistani if a person makes a will that one third of his property must be utilized in a certain way,his words must be acted upon.

Allah swt in sura Baqarah ayat no 180/181 says:

Prescribed for you when death approaches [any] one of you if he leaves wealth [is that he should make] a bequest for the parents and near relatives according to what is acceptable – a duty upon the righteous.
Then whoever alters it [i.e., the bequest] after he has heard it – the sin is only upon those who have altered it. Indeed, Allāh is Hearing and Knowing.
