Ask an Alim

if a man says to his second wife: “I have no more relation with my first wife and I will get rid of her very soon. what does it mean”

Q:

my husband had very high level of dispute with his first wife one year ago. she created drama to make him disrespected in front of family (this is not first time). they got married in 2006 and have three daughters. my husband told me that time “I have no relationship with her, she is nothing for me, I will soon get rid of her and then I will come to you in Malaysia so that we will stay together”. (we got married in 2011 and my husband forced me to abort my baby two times). Yesterday he said to me “this did not mean that I have divorced her but it is true that I dont have any physical or spiritual relationship with her. I cannot come to Malaysia as I could not find job in malaysisa. you must come back to pakistan, do job and live separately in a separate house.” I will do justice and divide my nights between you and her. I dont understand what is this situation. are they still married or got divorced.

A:

Waalaykum Salam.

If you’re trying to ask from an Islamic law perspective then yes they are
still married because divorce does not occur if you simply don’t have a
relation with your wife. There are other conditions to it.

I hope your issue is resolved.

Kind regards.
