Ask an Alim

I wanted to know whether my uncle’s daughter is my mahram.

Q:

Salaam,
I wanted to know whether my uncle’s daughter is my mahram. He has two wives. One of my uncle’s wife A (the elder) breastfed me. My uncle’s other wife B (the junior) has a daughter C. Is this daughter (C) from the wife B my mahram?
So my uncle has 2 wives and their children are each others’ half-siblings. Only one of the wives breastfed me. Are children from both wives my mahram? The children have one father but different mothers.
An imam at the local mosque told me that since the mothers are different, only the daughters of my uncle’s wife who breastfed me are my mahram, the daughters of the other wife are not my mahram and hence I could marry them. However, I see different answers on the internet.
Another scholar on the internet told me that it depends on the intention of the woman who fed me and whether she intended to make me mahram or not. She said her intention was only to feed me as I was crying and my mother had left me at home while she was gone somewhere else.
So please clarify this issue for me from the hanafi point of view.
Jazak Allah.

Alaikum salam
Its good to see you want to be accurate in knowing the Islamic laws.

In breastfeeding, there are few conditions that needs to be checked before it can be said whether mahram relationship has been formed or not.
In One of the books( الفقه علی المذاهب الخمسه ) which shows rulings of five important school of thoughts ( i.e Jaffry, Hanifi, shafeyi, maliki and hanbali) there is no sign of  ‘intention’ being one of the conditions that helps in making one mahram through breastfeeding.
As a result, you would be mahram for wife number A(who fed you) and her daughters. (provided the conditions of breast feeding were met to.  Please see the conditions in the following link : https://www.sistani.org/english/book/48/2338/)

Just to give you a food for thought…
Jaffry, hanifi…. are all different ways of life(like they differ in mentioning  conditions to become mahram too ), each one of them claims to be the only correct way of life, (in order to comply with  Prophet ( peace be upon him and his progeny)’s  famous saying which says that the Muslim nation will be divided into 72 .. ..out of which only one would be savior…)
So before practicing any school of thought one should check  whether its formed on solid proofs or not.otherwise his life and hereafter (which is unlimited life ) both will be in trouble.
