I want to know the status of my marriage whether it is ended or I am still in his Nikkah?

Aslam-o-Alaikum

I am Rubab Fatima, 33 years old lady. I got married in 2018 to one of my cousins; he is Ehl-e-Hadith by sect. He had some sexual disabilities as he was unable to develop sexual relations. Besides, he was used to torturing me physically, psychologically, socially, and financially. I tried to tolerate his behavior for 1.5 years but he was not changed. I talked to elders of my family regarding his behavior they tried to counsel him, but his behavior was not improved. After 2 years I left his home and shifted to my mother’s home. During all these circumstances I started to hate the husband a lot that I can’t live with him anymore. I am living with my mother for 1.5 years, my husband did not make any contact with me, my brothers tried to settle down the issues but they failed due to his ridged behavior. Now after 3.5 years of marriage my brother decided to end up and said the words that he is ending this relation (as being my guardian). Now I want to know the status of my marriage whether it is ended or I am still in his Nikkah?

The following is according to the Shia sect.

For a divorce to be correct, it has to have the following conditions:

1- You have to have two believing adults as your witness
2- The woman has to be clean of her menstrual period and also shouldn’t be pregnant
3- Proper Arabic words need to be uttered for the act to take place.
