Ask an Alim

I got aggressive and in front of my parents my words to her were, ( called her by name ) that I divorce you.

Q:

My wife and I never had a good relationship for a long time. There was instances when I will say if you do this you will be divorce and sometimes she would listen to me and won’t do and sometimes she will do it against my order.

But lately on Jan 24 this year, she started the fight and basically I got aggressive and in front of my parents my words to her were, ( called her by name ) that I divorce you. Said it again that I divorce you, and said it again that she divorce you.

Sometimes I think may be the divorce is not done but sometimes I feel like it’s over and divorce is done. I have no feeling in life anymore and would like to know the reality I don’t know what to do. Please help me out and let me know so that I can get ease of mind.

The following is according to the shia sect, as for the Hanafi ruling, you will have to ask the respected scholar.

For a divorce to be correct, it has to have the following conditions:

1- You have to have two believing adults as your witness
2- The woman has to be clean of her menstrual period and also shouldn’t be pregnant
3- Proper Arabic words need to be uttered for the act to take place.
