Ask an Alim

Do I have to share the topup value with the Real Estate Company?

Q:

Aslam O Alaikum Wa Rahma Tullah e Wa Barakatu hu,

My Name is Khalid. I hope you are Doing Good.
I have a Question regarding my Job Profession. I am working for a Real Estate Company. I am a Brokerage Consultant. In Buying Selling of any one Properties after the Transactions we Brokers are Liable to Give Commissions to Our Companies and after that they use to give us our Shares.

Now If we are doing one Deal of Buying amd Selling a House. After the Transaction whatever Commission will come 100% we will share with the Company. What If Seller is agreed on 150,000$ and Properties is being selling on 200,000$. Seller is agreed that if we will sell at 200,000$ he will give back 50,000$ to his Agent.
Does agent require to Share this topup value of 50,000$ with his Company?Where he is sharing the Commission of the transaction which he is committed to give this to his Company?
I hope you understand my Situation. Kindly Clear my Question as per Shariah Law. Barakallah Feek.
Aslamoalaikum

Wa Alaykumussalam

Thank you for your query.

If your contract with the real estate company is that you have to share the amount and everything has to be clear between you and them, then you can’t make the buyer write less and you get the amount hidden from the real estate to run from sharing the percentage between you and the real estate. But if the real estate allows getting the commission outside paperwork by writing less amount then it will be permissible.

Usually, the contracts are based on trust, and both parties expect crystal clear between them to run a fair business.

May Allah(swt) grant you success
