Ask an Alim

divorced on whatsapp

Q:

Salaams I’ve had a question in regards to saying Talaaq. Me and my wife married 4 years ago and right from the very beginning we have always had very bad times as far as I know and can remember in a argument few years back I said talaaq to her once then after a few months I think I said talaaq to her for the second time again as 2 years went by problems kept escalating we kept reconciling then my wife went to a shariah council to apply for a khula which I didn’t reply back to for few months they issued a divorce but I had called them and told them during the khula period me and my wife had sexual intercourse many times so the imaam raza told us that the talaaq is not valid so we carried on living are life’s separately still meeting having are ups and downs not talking for 6 weeks at a time or not seeing each other now 2 months ago from today’s date things got so worse that I decided being in a very emotional state I wrote her a message on WhatsApp saying I am giving you talaaq talaaq talaaq 3 times it was a bad and hurtful ending it like that but as I wanted to make sure she’s ok and as me and her spoke I found out she was just started her periods at the time.

My question is that am I still married to her or are we completely divorced to each other?

A:

Waalaykum Salam,

Thank you for your Question

The following is according to the Shia sect.
For a divorce to be correct, it has to have the following conditions

1- You have to have two believing adults as your witness
2- The woman has to be clean of her menstrual period and also shouldn’t be pregnant
3- Proper Arabic words need to be uttered for the act to take place.

Best wishes
