consequences of not fulfilling fathers will

Q:

ASLAM O ALIKUM

sir my father donate 1/3 of a plot to masjid oral in front of all family members.
now after my father death if the son/daughter not fulfill the will of father
then what are the consequence please englighten in this matter in light of quran and hadees.

A:

Wa alaykum salaam

Thank you for your question.

It is compulsory upon the heirs to act upon the will.
According to Ayatullah Sistani, if a person makes a will that one-third of his property must be utilized in a certain way, his words must be acted upon.

Will (Waṣiyyah)

Allah swt in sura Baqarah ayat no 180/181 says:

Prescribed for you when death approaches [any] one of you if he leaves wealth [is that he should make] a bequest for the parents and near relatives according to what is acceptable – a duty upon the righteous.
Then whoever alters it [i.e., the bequest] after he has heard it – the sin is only upon those who have altered it. Indeed, Allāh is Hearing and Knowing.
