Buying shop on pre launch rates and getting rent on it?

Q:

I have bought a shop in a construction and real state company. What they actually offer that they sell a shop to you and they take it on rent from you and give you mutually agreed amount. The one in which i made investment is right now in situation that Building ground digging started recently. What their terms were that if you buy a shop, rent will be started from day you make full payment. As this money goes into investment or construction of project. so the rent i am getting on shop,as it is not fully constructed, is halal or haram? As i have read somewhere that whenever commodity invovles in specific thing that makes it riba free.

SalamunAlaikum

If the company geniunely sells you the shop with providing necessary details of it and not just on papers, then the deal is valid although you would not be deserving the rent of the shop till the shop is ready to use. In that case, if the company still pay you the rent and is comfortable with you using this maney even if it knows that you are not titled to get the amount according to the Shariah laws you follow then there is no harm in using this money.

With respect to the commodity making the deal riba free is in some cases and always. For furthur details, please refer to the book Islamic Laws.
