Bought something with haram money and its still in use.

Q:

I earned some money, i did not know that the Money was Haram and I Bought a Phone with that Money some of the money I gave as Sadqa and the rest was used to buy the Phone the remaining amount of the phone was paid by my father which was Halal Money. Now I  want to sell that phone and buy a new one. What Should I Do? The Phone is Bought with some amount of Haram Money but I did not know at that time that it was Haram Money.

Thank you for your query.

You haven’t mentioned the way you earned the money. Therefore, we aren’t really sure that the money earned is really unlawful.

Assuming that the money earned is really unlawful, then you don’t need to sell off the mobile rather you have to pay that amount of Haram money to its owner. If you know the owner you must pay him back. And if you do not know the owner then by getting permission from your Mujtahid’s office you can pay it to the needy(Faqeer) person.

If you wanted to sell the mobile and get a new one, then you can do so but you have to make sure you pay the amount which you have used, back to the owner.

According to Ayatullah al-Udhma Sayyid Ali Sistany:

Ruling 2566. If a person usurps something, he must return it to its owner. And if the item is destroyed and it was of some value, he must replace it for the owner as per the explanation in Rulings 2576 and 2577.
